MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 1993 <br />residents of the area have just begun to use the <br />property. <br />Scalze reported that the Park Commission has not had <br />adequate time to plan for the use of this area. <br />LaValle agreed that the matter should be tabled to <br />allow the Parks & Recreation Commission time to <br />evaluate the request. <br />Morelan asked if there was opposition to the temporary <br />parking request at this point. There was not. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-10-326 - TABLING ACTION ON THE <br />REQUEST OF DON RUE FOR USE OF CITY PARK PROPERTY AS <br />TEMPORARY PARKING, SENDING THE MATTER BACK TO THE PARK <br />AND RECREATION COMMISSION FOR THEIR EVALUATION AND <br />RECOMMENDATION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Hanson, Morelan, Scalze. <br />Nays (0). Resolution declared adopted. <br />Scalze suggested that staff determine the kind of costs <br />the City will incur in additional insurance premium by <br />allowing private use of public property. <br />The City Attorney did not believe the cost would be <br />substantial, and felt that any agreement with the Trane <br />Company would ensure that the City's costs are covered. <br />Hanson suggested that Trane Company would be required <br />to enter into a hold harmless agreement with the City, <br />and the City Attorney agreed. <br />Scalze asked if the Park Dedication Ordinance was <br />structured to allow the private rental of City park <br />land. <br />The City Attorney noted that whatever arrangement is <br />entered into with Trane Company would be short-term in <br />nature and the City would have the ability to terminate <br />the use at any time. The Attorney also noted that the <br />park property would be open to the use of the general <br />public at any time, including any improvements that <br />Trane Company might make to the property. <br />Scalze noted that the only road access to the parking <br />lot would be through the Trane Company parking lot. <br />Page 11 <br />
