MINUTES CITY COUNCIL OCTOBER 13, 1993 residents of the area have just begun to use the property. Scalze reported that the Park Commission has not had adequate time to plan for the use of this area. LaValle agreed that the matter should be tabled to allow the Parks & Recreation Commission time to evaluate the request. Morelan asked if there was opposition to the temporary parking request at this point. There was not. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION N0. 93-10-326 - TABLING ACTION ON THE REQUEST OF DON RUE FOR USE OF CITY PARK PROPERTY AS TEMPORARY PARKING, SENDING THE MATTER BACK TO THE PARK AND RECREATION COMMISSION FOR THEIR EVALUATION AND RECOMMENDATION The foregoing resolution was duly seconded by Pedersen. Ayes (5) LaValle, Pedersen, Hanson, Morelan, Scalze. Nays (0). Resolution declared adopted. Scalze suggested that staff determine the kind of costs the City will incur in additional insurance premium by allowing private use of public property. The City Attorney did not believe the cost would be substantial, and felt that any agreement with the Trane Company would ensure that the City's costs are covered. Hanson suggested that Trane Company would be required to enter into a hold harmless agreement with the City, and the City Attorney agreed. Scalze asked if the Park Dedication Ordinance was structured to allow the private rental of City park land. The City Attorney noted that whatever arrangement is entered into with Trane Company would be short-term in nature and the City would have the ability to terminate the use at any time. The Attorney also noted that the park property would be open to the use of the general public at any time, including any improvements that Trane Company might make to the property. Scalze noted that the only road access to the parking lot would be through the Trane Company parking lot. Page 11
