MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 1993 <br />The City Attorney pointed out that the City holds <br />property in trust for the public. A member of the <br />public could object to any use that limits the public's <br />access to public property. <br />ASSESSMENT Hanson opened the continuation of assessment hearing <br />HEARING the improvement of Vanderbie Street lying between the <br />IMP. NO. north line of LaBore Road and the south line of Al1en <br />92-11 Avenue, and Allen Avenue lying between the east line of <br />VANDERBIE/ DeSoto Street and the west line of Edgerton Street by <br />AT•T•EN AVE. storm sewer, water main, concrete curb and gutter, and <br />street reconstruction. The amount proposed to be <br />assessed is $307,609.00. <br />The City Administrator reported that the assessment <br />hearing was continued from October 12th in order to <br />give the staff time to contact those property owners <br />whose assessment amount had changed. These included <br />the Neamy property at 2858 Vanderbie, whose dividable <br />lot was reoriented towards LaBore Road, the Mathison <br />property at 466 Al1en Avenue, whose assessment was <br />increased due to a second water service connection, the <br />Scalze property at 467 Allen, whose water main <br />assessment was deleted since Mr. and Mrs. Scalze have <br />already been assessed for water main, and the Bease <br />property at 547 Allen Avenue, where there was an error <br />in the amount of footage assessed. The Administrator <br />reported that these property owners were contacted <br />about the change in their assessment amount. Mr. Bease <br />has requested a 15 year payment period rather than the <br />10 years proposed. The Administrator pointed out that <br />the City's financing is based on 10 years, and there <br />would be the consistency issue to consider as well. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-10-327 - ACCEPTING FOR THE RECORD THE <br />LETTER DATED OCTOBER <br />REGARDING ASSESSMENT <br />N0. 92-11 <br />13, 1993 FROM MR. JOE BEASY <br />OF HIS PROPERTY FOR IMPROVEMENT <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Hanson, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Pedersen asked if there were much benefit to Mr. Beasy <br />in having his assessment spread out over 15 years <br />versus 10. <br />The City Administrator pointed out that there is a <br />break-even point beyond which it is no longer feasible <br />to extend an assessment.
