MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 1993 <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-10-322 - ADOPTING THE ASSESSMENT ROLL <br />FOR IMPROVEMENT NO. 93-7, LITTLE CANADA ROAD STORM <br />SEWER IMPROVEMENT, AS PRESENTED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />AMENDMENT Council was informed that Two S Properties has <br />TO PUD asked that action on their request for PUD <br />AGREEMENT- amendment be continued until the next Council <br />TWO S meeting, since they were not able to attend this <br />PROPERTIES evening's meeting. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-10-323 - CONTINUING THE PUBLIC <br />HEARING ON THE APPLICATION FOR AMENDMENT TO PUD <br />AGREEMENT MADE BY TWO S PROPERTIES UNTIL THE OCTOBER <br />27, 1993 COUNCIL MEETING <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Hanson, Pedersen, Scalze. <br />Nays (O). Resolution declared adopted. <br />Scalze felt the Council needed additional information <br />on the legality of the billboard on the mini-storage <br />property. <br />The City Attorney reported that he has reviewed the <br />ordinance, which states that billboards are <br />non-conforming and must be removed within five years of <br />adoption of the ordinance. The ordinance prohibiting <br />billboards was adopted in April of 1983. <br />Scalze felt that Mr. Jones of Two S Properties should <br />be made aware of this information prior to the next <br />Council meeting. <br />The City Attorney replied that it was his understanding <br />that City staff had already forwarded a copy of the <br />ordinance to Mr. Jones. <br />Pedersen pointed out that Jones will argue that they <br />have a lease with Naegele that runs for some time. <br />The City Attorney pointed out that such a lease is <br />between the property owner and Naegele, and does not <br />affect the City. <br />Page 4 <br />
