MINUTES <br />CITY COUNCIL <br />DECEMBER 8, 1993 <br />the Venetian Inn, these areas have been fenced as well. <br />LaValle felt that the situation has worked well in the <br />past. LaValle suqgested that the City could merely <br />indicate that outdoor sales and consumption is <br />restricted to a defined area on the premises, and that <br />area should be fenced off. <br />Scalze pointed out that the ordinance does not make <br />this requirement. While the current liquor <br />establishment owners are willing to do this, perhaps <br />the ordinance should include this control should <br />ownership change. <br />Cossack pointed out that in their instance the alcohol <br />is sold within the building, and then taken out the <br />back door to be consumed while watching the volleyball <br />game. Cossack also pointed out that if the fenced-in <br />volleyball area gets crowded, a spectator may stand <br />outside the fenced area to watch the game and consume <br />his or her drink. <br />Scalze reported that the controls she is talking about <br />are typical of what other cities have. Under the <br />current ordinance, the City is not allowed to regulate <br />outdoor sales and consumption. <br />LaValle pointed out that if drinking is restricted to <br />inside a fenced-in area, if there were a large <br />tournament going on and alcohol being consumed outside <br />the fence, this would be a violation of the ordinance. <br />Cossack reported that they do not want to see people <br />drinking at the front curb, and do make efforts to <br />police their parking lot. However, Cossack felt that <br />additional regulations could hurt their business. <br />Cossack again pointed out that there has never been a <br />police call to Gordies regarding the volleyball court. <br />Scalze asked how many tournaments were conducted at <br />Gordies in a given year. <br />Cossack replied that they generally have six <br />tournaments per year. Cossack again stated that they <br />do not believe they have a problem at their business, <br />and would take measures to resolve any problems that <br />might occur. Cossack pointed out that the City has the <br />ultimate authority over the business in the renewal of <br />its liquor license. <br />LaValle indicated that he thought restricting sales and <br />consumption to a designated fenced area would work, <br />however, can see on occasions that it would not. <br />Page 12 <br />
