MINUTES <br />CITY COUNCIL <br />DECEMBER 8, 1993 <br />Scalze pointed out that notice that this item was going <br />to be discussed was sent to property owners within 150 <br />feet of the on-sale liquor establishments in the City. <br />Hanson reported that the City received one letter from <br />Gerald House, a property owner at the Fluer Royal <br />Condominiums. Mr. House indicates that the volleyball <br />games at Gordies are noisy and felt the CUP to allow <br />volleyball at Gordies should be revoked. This is the <br />only written objection that the City has received on <br />the issue before it tonight. <br />Morelan pointed out that the issue is whether or not to <br />adopt restrictions for outdoor sales and consumption of <br />liquor, and the CUP for outdoor recreation at Gordies <br />is not the issue before the Council. <br />LaValle pointed out that this is the only objection <br />that the City received. Staff indicated that <br />approximately 200 notices were mailed to adjacent <br />property owners on this issue. <br />Tom Duray, Hoggsbreath, reported that he has been a <br />resident of the City for 13 years, and owner of the <br />Hoggsbreath for the past 17 years. Duray indicated <br />that he is concerned about how is neighbors view the <br />operation of his business, and has always attempted to <br />address their concerns when he has been aware of them. <br />Duray reported that in order to maintain his business, <br />he is looking at other avenues to try. Duray pointed <br />out that the late-night entertainment business is no <br />longer what it once was. Therefore, outdoor recreation <br />is being looked into to create more day-time business. <br />Duray pointed out that the Aoggsbreath has already <br />increased their food business. Where 10 years ago <br />Hoggsbreath sold 950 liquor and 5o food, today they <br />sell 45% food and 55% liquor. People are no longer <br />drinking like they once were, and in order to hold onto <br />customers, liquor businesses must come up with some new <br />ideas. Duray reported that he has begun what he <br />considers to be a two part project. The first part <br />involves the construction of an outdoor deck, and the <br />second part is the construction of an outdoor <br />volleyball court adjacent to the deck. The volleyball <br />court would be totally fenced in and the only entry to <br />the court would be through the building and across the <br />deck. The deck itself is totally enclosed. Duray <br />reported that the deck has been in existence for two <br />years, and to his knowledge there have been no noise <br />complaints due to the deck. <br />Duray felt that any changes to the City's ordinance <br />would be detrimental to his business.
