MINUTES <br />CITY COUNCIL <br />DECEMBER 8, 1993 <br />ASSESSMLN'P The City Attorney recommended that the assessment <br />HEARING hearing for house demolition for 34 East Little Canada <br />34 EAST Road be continued indefinitely at this time. This <br />LITTLE matter has been referred to Ramsey County District <br />CANADA RD. Court for a ruling on the expenses associated with the <br />assessment, and the Attorney recommended that the <br />assessment hearing be continued until that ruling is <br />received. <br />The City Attorney also requested that this matter be <br />discussed in closed session following the Council <br />meeting. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-12-280 - CONTINUING THE ASSESSMENT <br />HEARING FOR COSTS ASSOCIATED WITH STRUCTURE DEMOLITION <br />FOR 34 EAST LITTLE CANADA ROAD INDEFINITELY PENDING A <br />RULING FROM THE RAM5EY COIINTY DISTRICT COURT, AND <br />DECLARING THAT THIS MATTER WILL BE DISCUSSED IN CLOSED <br />SESSION FOLLOWING THIS EVENING'S COUNCIL MEETING <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Scalze, Morelan, Hanson, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />OUTDOOR Scalze reported that the issue of regulation of outdoor <br />SALE & sales and consumption of liquor arose in conjunction <br />CONSUMP'PION with Gordies' application for Conditional Use Permit <br />OF LIQUOR for outdoor recreation, i.e. volleyball. It also came <br />to the Council's attention that there may be a similar <br />application from another liquor establishment in the <br />City, and the Council felt the issue of City control of <br />outdoor sale and consumption during recreational events <br />should be reviewed. <br />Morelan asked if it were correct that the current <br />ordinance allows liquor sale and consumption anywhere <br />on the property and not just within the building. <br />The City Attorney replied that premises is not defined <br />in either State Law or the City's Liquor Ordinance, <br />therefore, premises is construed to be the address of <br />the liquor establishment. <br />The City Administrator pointed out that the property <br />owners within 150 feet of on-sale liquor establishments <br />in the City have been notified that this matter will be <br />discussed tonight at 8:30 P.M. Therefore, it was the <br />consensus of the Council to delay discussion until that <br />time. <br />Page 8 <br />
