MINUTES CITY COUNCIL MARCH 9, 1994 can be applied uniformly to all property owners in the City. Pedersen pointed out that the property is unique in that the shopping center does not lie parallel to Rice Street and the signs on the front of the shopping center cannot be seen from the street. Pedersen was concerned that the minutes would not reflect all the previous discussion the Council had on this issue, noting that the matter was first presented and discussed by the Council at its January 26th regular meeting. Pedersen pointed out that that discussion is the basis for the action that the Council will take on this variance request. Morelan pointed out that item #2 of the January 10th Planners report indicates that the hardship is the layout of the building on the property. Scalze did not believe the larger sign should be approved in such a way so that no one else has a legal right to such a sign. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 94-3-56 - APPROVING THE VARIANCE TO THE SIGN PROVISIONS OF THE ZONING ORDINANCE ALLOWING A FREE-STANDING SIGN WHICH EXCEEDS THE MAXIMUM SURFACE AREA OF 200 SQUARE FEET AS REQUESTED BY TEAM PROPERTIES, REPRESENTING THE MARKET PLACE SHOPPING CENTER, DUE TO TAE HARDSHIP WI-IICH EXISTS IN THE LAYOUT OF THE BUILDING ON THE PROPERTY, SUBJECT TO COMPLIANCE WITH OPTION #2 IN THE CITY PLANNER'S REPORT DATED JANUARY 10, 1994, AND SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE PLANNING COMMISSION The foregoinq resolution was duly seconded by Morelan. Ayes (5) LaValle, Morelan, Hanson, Pedersen. Nays (1) Scalze. Resolution declared adopted. CONCEPT Mr. Jon Uban, Dahlgren, Shardlow and Uban, appeared REVIEW - before the Council and presented a concept proposal R-2 for the rezoning of the John Mitchell property in DEVELOPMENT Little Canada to R-2 and development of the site with THE MITCHELL 13 townhome structures totalling 26 units.
