MINUTES CITY COUNCIL JUNE 22, 1994 access to for water craft. There was no one else from the general public present wishing to comment on this matter. Upon motion by Scalze, seconded by Morelan, the public hearing was closed. The City Planner pointed out that Lot 1, and portions of Lots 2, 3, 4, and 5, Block l, lie within the boundaries of the City of Vadnais Heights. Road access for four of these lots is through property within Vadnais Heiqhts. The Planner recommended that a condition of approval of the Preliminary Plat be that the corporate boundary issue be settled between Little Canada and Vadnais Heights. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTSON NO. 94-6-160 - APPROVING THE PRELIMINARY PLAT FOR FOURTEEN (14) SINGLE-FAMILY LOTS AND ONE (1) OUTLOT FOR TWIN LAKE PINES ADDITION AS REQUESTED BY PRATT HOMES AS WELL AS A VARIANCE FOR CUL-DE-SAC LENGTH EXCEEDING THE MAXIMUM ALLOWED UNDER THE ORDINANCE CONTINGENT UPON COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS CONTAINED IN HIS REPORT DATED MAY 10, 1994, SUBJECT TO DESIGNATION OF OUTLOT A A5 PRIVATE OPEN SPACE WITH NO PUBLIC ACCESS AND UNDISTURBED DRAINAGE AND UTILITY EASEMENT, WITH CONTROL OF OUTLOT A TO BE BY THE HOMEOWNERS~ ASSOCIATION FOR THE FOURTEEN (14) LOTS ONCE THOSE LOTS HAVE BEEN DEVELOPED AND HOMES OCCUPIED BY THE PROPERTY OWNERS, SUBJECT TO RESOLUTION OF THE CORPORATE BOUNDARY ISSUE BETWEEN THE CITIES OF LITTLE CANADA AND VADNAIS AEIGHTS The foregoing resolution was duly seconded by LaValle. Ayes (5) Scalze, LaValle, Aanson, Morelan, Pedersen. Nays (O). Resolution declared adopted. Remerowski asked if Vadnais Heights would be able to require a park land dedication for this plat due to the fact that a portion of the property lies in Vadnais Heights. Pratt reported that he has not presented this plat to Vadnais Heights as of this date, therefore, does not know how they will address the park dedication issue. 29
