MINUTES <br />CITY COUNCIL <br />JUNE 22, 1994 <br />distance from the property line to the front of the <br />garage. The house itself would be 25 feet back from <br />the property line. Maas states that the City Planner's <br />report presents a fair representation of the reasons <br />for the variance. <br />Scalze asked if Mr. Maas was aware that this particular <br />lot already has a 5 foot setback variance. <br />Maas replied that he was not, but pointed out that he <br />wishes to line up his home with the adjacent homes. <br />These homes have a 22 foot setback. <br />Scalze pointed out that Lots 1 through 6 had been <br />granted 5 foot setback variances at the time of <br />platting, and asked if an additional variance was <br />granted. <br />The City Administrator replied that to his knowledqe <br />only the 5 foot variance was approved by the Council. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Pedersen, the <br />public hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-6-149 - APPROVING THE FRONT YARD <br />SETBACK VARIANCE AS REQUESTED BY MR. JOHN MAAS FOR <br />PROPERTY LOCATED AT 2439 SUNRISE DRIVE SO THAT HE MIGHT <br />CONSTRUCT A HOME ON THE PROPERTY WITH A FRONT YARD <br />SETBACK OF TWENTY-TWO FEET FROM TAE PROPERTY LINE <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE <br />CITY PLANNER AS CONTAINED IN AIS REPORT DATED JUNE 6, <br />1994, AND SUBJECT TO THE BUILDING INSPECTOR VERIFYING <br />THAT THE FOOTINGS AND FOUNDATION ARE NO FURTHER FORWARD <br />INTO THE SETBACK THAN THE ADJACENT HOUSES <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0).
