MINUTES <br />CITY COUNCIL <br />JtJI,Y 13, 1994 <br />not qoing to be used for private fund-raisers. <br />LaValle pointed out that the property owners adjacent <br />to the park were very much against tournament usage of <br />the Park, and the Council assured them that it would <br />not be used for outside tournaments. <br />Morelan stated that he did not recall a definite policy <br />on the issue of tournament usage of the park. <br />The City Administrator reviewed past minutes of the <br />June 22, 1988 and August 26, 1989 Council meetings. In <br />1988 the Council's consensus was that there would be no <br />tournament softball in Pioneer Park. In 1989 the <br />Council passed a resolution approving the restricted <br />use of the Park for tournaments. <br />Hanson suggested that if this request is approved, the <br />City might be faced with repeated requests. Although <br />the cause is a worthy one, Hanson was concerned about <br />the City's liability. <br />Morelan felt that the Park should be made available for <br />fund-raising tournaments. While there are liability <br />concerns, those can be addressed with proper insurance <br />coverage. Morelan stated that he had no problem with <br />the concept, only the details needed to be worked out. <br />Morelan stated that he would not support tournaments at <br />Pioneer Park every weekend, pointing out that this is <br />an exceptional thing. <br />The City Attorney reported that in order to sell 3.2 <br />liquor as requested, the individual would have to <br />purchase Dram Shop insurance. General liability <br />insurance would also be required to protect both the <br />individual and the City from liability concerns. The <br />Attorney reported that a gambling license would be <br />needed to allow the individual to conduct a raffle and <br />bingo as proposed. <br />LaValle pointed out that the request is from someone <br />who is not a resident of the City. LaValle stated that <br />he would not support the use of Pioneer Park for <br />private fund-raising tournaments. <br />Pedersen pointed out that Pioneer Park is a public <br />facility and should be made use of. Pedersen felt the <br />park should be used as requested provided that the City <br />18 <br />
