MINUTES <br />CITY COUNCIL <br />JULY 13, 1994 <br />within 10 to 15 percent of ineeting the masonry <br />requirements of the I-P District. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 94-7-185 - APPROVING THE PROPERTY <br />DIVISION OF 3065 SPRUCE STREET AS REQUESTED BY MESSR5. <br />STOCKNESS AND NIELSEN SUBJECT TO COMPLIANCE WITFI THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION AND PARK & <br />RECREATION COMMISSION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Hanson, Scalze, Pedersen. <br />The Council reviewed the request of Tom and Gayle <br />Nielsen for vacation of 6 foot drainage and utility <br />easement on the adjacent property due to the relocation <br />of the property line relative to the property division <br />just approved. It was noted that a public hearing must <br />be held at which the Council would consider the <br />vacation request. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 94-7-186 - CALLING FOR A PUBLIC HEARING <br />TO CONSIDER THE VACATION OF DRAINAGE AND UTILITY <br />EASEMENT AS REQUESTED BY TOM AND GAYLE NIELSEN, WITH <br />DATE AND TIME OF HEARING TO BE SCHEDULED BY CITY STAFF <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Hanson, Scalze, Morelan. <br />Nays (0). Resolution declared adopted. <br />Morelan asked if the City should stipulate the size of <br />the variance. <br />The City Planner pointed out that the Planning <br />Commission has recommended that the building have a 4 <br />foot masonry wainscot provided that the City Engineer <br />determines that soils could support it. The Planner <br />suggested that any variance approval either refer to <br />footages or percentages. The Planner indicated that he <br />would have to calculate the amount of variance being <br />requested. <br />il <br />
