MINUTES <br />CITY COUNCIL <br />AUGUST 10, 1994 <br />*APPOINTMENT OF ELECTION JUDGES TO THE PRIMARY AND <br />GENERAL ELECTIONS~ <br />*APPROVAL OF A RESOLUTION AUTHORIZING REIMBURSEMENT <br />WITfi FUTURE BOND PROCEEDS; <br />*APPROVAL OF TFIE VOUCHERS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Morelan, Pedersen. <br />Nays (0). Resolution declared adopted. <br />DIANNA LANE The City Administrator reported that the Dianna Lane <br />RETAINING retaining wall was installed after the public <br />WALL improvements were in place. The Administrator reported <br />that based on the information which he has reviewed, it <br />did not appear to be the intent of the City Council to <br />accept the retaining wall at the time the public <br />improvements were accepted. The retaining wall is <br />currently in a state of disrepair and may be a safety <br />concern due to its height. The retaining wall may also <br />exist on City right-of-way. <br />The Administrator asked if it was the Council's feeling <br />that the City had any sense of responsibility in the <br />matter. The Administrator indicated that it was his <br />recommendation that the City has no financial <br />responsibility. The City may want to get involved in <br />coordinating any efforts for improving the wall, with <br />the possibility of the improvements being assessed <br />against the Dianna Lane properties. <br />Hanson reported that he has looked at the walls, and <br />feels they are a safety hazard. Hanson was concerned <br />about their height as well as the fact that the wall <br />timbers are rotting. Hanson felt that if the walls are <br />on City right-of-way, the City had some responsibility <br />for repairing, replacing, or removing the walls. <br />Hanson felt that whether or not the City accepted the <br />retaining walls was a moot question at this point. <br />There is a safety hazard existing, and the walls should <br />either be removed and the area graded, or the walls <br />replaced. <br />Scalze pointed out that there are some unknowns at this <br />point, those being whether or not the walls are on the <br />City's right-of-way, how much area is needed to regrade <br />6 <br />
