MINUTES <br />CITY COUNCIL <br />AUGUST 10, 1994 <br />should the wall be removed, and the cost of replacing <br />the wall. Scalze suggested that perhaps the City <br />Administrator should conduct some neighborhood meetings <br />to determine how the neighborhood feels about the <br />issue. <br />Hanson suggested that the property owners at the north <br />end of Dianna Lane and on Reidmont Avenue would say <br />that the retaining walls have no benefit to their <br />properties. Hanson questioned the City~s ability to <br />assess for a retaining wall improvement. Hanson <br />suggested that the City determine whether or not the <br />retaining walls are on City right-of-way. <br />Jack Desai, Dianna Lane resident, thanked the City <br />Council for their time and efforts on behalf of the <br />citizens of the City. Desai reported that he <br />remembered that the retaining walls were put in as part <br />of the Dianna Lane street improvement. For many years, <br />the City mowed the grass around the retaining walls. <br />When the Johnson's purchased their home at Arcade <br />Street and County Road B-2, they began mowing this <br />area. <br />Karen Johnson reported that she has seen the City <br />mowing the grass adjacent to the retaining walls. <br />Desai also reported that the City has done some <br />maintenance work on the walls. The current condition <br />of the walls has been discussed with the City <br />Administrator, who has indicated that the City has no <br />responsibility for the walls. Desai reported that the <br />City Administrator indicated, however, that should the <br />walls be located on City right-of-way, the City would <br />have to approve any improvements to the walls. <br />Desai referred to the August, 1980 minutes in which <br />Dianna Lane was accepted by the City, and pointed out <br />that the resolution accepting the street did not <br />exclude the retaining walls. Desai felt that when the <br />City accepted a piece of property, everything located <br />on that property would be accepted as well. Desai <br />pointed out that the City collects property taxes from <br />the Dianna Lane properties, and these residents have <br />not come to the City asking for anything in the past. <br />Desai pointed out that the retaining walls have become <br />safety hazards and something needs to be done about <br />them. <br />7 <br />
