MINUTES <br />CITY COUNCIL <br />SEPTENIBER 28, 1994 <br />wire on top of fences in the Industrial Districts. The <br />problem is when an Industrial property abuts <br />Residential, then the fence regulations of the <br />Residential District govern the situation. <br />LaValle sugqested that the matter be tabled until the <br />Code can be reviewed regarding this issue. <br />Scalze asked if LaValle was suggesting that the Code be <br />amended to allow barbed wire on fences on Industrial <br />property that abuts Residential. Scalze pointed out <br />that this could affect most of the City. <br />LaValle suggested that the Sheriff's Department be <br />asked for a recommendation on this issue. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-9-333 - TABLING ACTION ON TI-IE <br />MCCUMBER REQUEST FOR CONDITIONAL USE PERMIT TO ALLOW A <br />SPECIAL PURPOSE FENCE PENDING ADDITIONAL REVIEW OF THE <br />CITY CODE GOVERNING THESE TYPES OF FENCES <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Hanson. <br />Nays (2) Scalze, Morelan. Resolution declared adopted. <br />Hanson suggested that the City Administrator do a <br />physical observation of the City to determine how many <br />similar situations already exist. <br />McCUmber reported that he drove around the City and <br />spotted 17 fences with barbed wire on top that abut <br />residential property. <br />Scalze felt that if a lot of violations already exist <br />it would be necessary to consider revising the Code. <br />McCumber stated the need to protect his property. <br />Morelan replied that a property owner has the right to <br />protect his property, but the Code does not allow a <br />property owner to use barbed wire to do it. <br />McCumber reported that most other cities do not have an <br />ordinance prohibiting barbed wire on top of fences. <br />11 <br />
