MINUTES <br />CITY COUNCIL <br />NOVEMBER 23, 1994 <br />the City probably does not incur any liability for <br />contamination that may°exist on a site prior to the <br />City's acquisition of tbat site. However, that law <br />could change, and if so~;the City has no protection <br />from future liability ~~~TThe Attorney suggested that <br />should the City be int~ested in acquiring the site, <br />some preliminary evalu~ion be done to determine if <br />there are contamination problems. <br />Morelan asked why the City would take the property if <br />it has already been cla~sified as a wetland. <br />The Administrator explained that the City would not buy <br />the property, but could take title to it for future <br />park purposes. The Administrator pointed out that the <br />City is not obligated to take title to the property. <br />The Administrator stated that should the City not take <br />title, it would go to auction. If the parcel is not <br />sold, it stays in Trust Exempt status. The <br />Administrator suggested that if there is no interest in <br />the site on the part of the Park & Recreation <br />Commission, then the Council may decide the parcel <br />should go to auction and the problem is solved. <br />Morelan suggested that if the Commission is not <br />interested in the property, that the City should not <br />take it and assume liability and maintenance for the <br />site. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-11-413 - INSTRUCTING STAFF TO SUBMIT <br />CONSIDERATION OF THE CITY~S TAKING TITLE TO THE TAX- <br />FORFEITED PARCEL ON COUNTY ROAD B-2 TO THE PARK & <br />RECREATION COMMISSION FOR A RECOMMENDATION <br />The foregoinq resolution was duly seconded by Pedersen. <br />Ayes (4) Morelan, Pedersen, LaValle, Hanson. <br />Nays (0). Resolution declared adopted. <br />RUTH STREET Jim Gustafson, Ruth Street resident, reported that he <br />PARKING has discussed the parking situation on Ruth Street with <br />a fair amount of the residents along the street. Their <br />concern is for the safety of the children living along <br />Ruth Street, and feel that getting parked cars off the <br />street was a first step in protecting their safety. <br />17 <br />
