M:CNUTES <br />CLTY COUNCIL <br />NOV.II~SBER 23, 1994 <br />The City Attorney asked Mr. Schmidt who told him he had <br />to sell his property. <br />Schmidt replied that no one told him this. Schmidt <br />again stated that his Torrens title was upheld in court <br />on three occasions. Schmidt asked when someone enters <br />his property if that is civil or criminal trespass. <br />Schmidt stated that he is asking the City this question <br />and he cannot get an answer. <br />LaValle pointed out that the situation is that someone <br />is using the Schmidt property off of Keller Parkway for <br />ingress and egress. <br />Schmidt felt that problem will be resolved in the <br />Spring when the County improves Keller Parkway. <br />Schmidt felt it was too bad he cannot sit down with his <br />neighbor and discuss the matter. <br />The City Administrator reported that he stopped at the <br />Schmidt home when the motorcycle incident Schmidt <br />mentioned was occurring. The Administrator did not <br />recall at any time during that incident that the <br />Sheriff's Department said reports would not be issued <br />at the direction of the City Attorney. The <br />Administrator reported that the Sheriff's Department <br />does have a policy of not responding to calls made by <br />Schmidt given the inordinate number of calls of a petty <br />nature that have been made. <br />Schmidt asked if 911 calls are received at City Hall. <br />The Administrator reported that 911 calls are received <br />and dispatched by the Sheriff's Department. The <br />Administrator pointed out that the dispute is a <br />property boundary issue between two neighbors. <br />Schmidt reported that the dispute is over because the <br />property is his. <br />The Administrator reported that Schmidt wants the City <br />to enforce trespass on his property, even though it is <br />a civil issue. The Administrator reported that the <br />City has tried to mediate between these two property <br />owners, and an inordinate amount of time has been spent <br />on the part of City staff, the Sheriff~s Department, <br />and the City Attorney in dealing with this dispute. <br />The Administrator suggested that the City offer the <br />6 <br />
