MINUTES <br />CITY COUNCIL <br />DECEPSBER 21, 1994 <br />will be required to dedicate either additional right- <br />of-way for Jackson Street or for the cul-de-sac. <br />Additional right-of-way is needed for either option. <br />Gary Kajalski, attorney representing Mr. Tima, reported <br />that Mr. Tima first proposed the division of his <br />property in 1986 and feels he has waited long enough on <br />that issue. Kajalski pointed out that the City <br />Engineer~s report indicates the need to correct a <br />problem with the dead-end street situation on Bluwood <br />and Australian irrespective of Mr. Tima's property <br />division. Mr. Tima's preference is that Jackson Street <br />be put through. He is not against improvement of cul- <br />de-sacs at the end of the streets, if those cul-de-sacs <br />are small enough that they don~t take away value of his <br />property and lots. Kajalski reported that Mr. Tima <br />feels there are additional benefits in improving <br />Jackson Street for emergency vehicle access and <br />snowplowing, and he is willing to dedicate an <br />additional 7 feet of road right-of-way in return for <br />subdivision approval. Mr. Tima realizes that he would <br />be responsible for his fair share of assessments for <br />the improvement of Jackson Street. Kajalski reported <br />that he sees nothing in the Engineer's report <br />indicating that increased traffic would result in the <br />area from the improvement of Jackson Street. <br />Kajalski reported that should the City decide to <br />improve cul-de-sacs at the ends of Bluwood and <br />Australian, Mr. Tima's position is that all parties <br />benefitting from the cul-de-sacs should equitably share <br />in the cost. Mr. Tima feels the cul-de-sacs would <br />benefit the abutting properties, and not solely his <br />property. <br />Kajalski also pointed out that dedication of an <br />additional 7 feet of right-of-way by Mr. Tima should <br />result in no problems with required setbacks. <br />Berniece Magnuson, 95 Australian, reported that she <br />favored the improvement of the Jackson Street <br />connection Magnuson believed this option to be less <br />expensive, and pointed out that it would save $4,000 in <br />the cost of the trail improvement planned for this <br />area. Magnuson presented two letters submitted by <br />parents using her day care business. These parents <br />prefer the street improvement option since it would <br />allow school buses to drive down the street. Currently <br />14 <br />
