MINiTPES <br />CITY COUNCIL <br />JANUARY 25, 1995 <br />discuss the issues with Morelan, and a recommendation <br />be brought back to the Council. <br />Scalze pointed out if Jackson Street is vacated, the <br />sideyard setback would be 10 feet for the Morelan <br />property rather than 30 feet as a corner lot. A 30 <br />foot frontyard setback is standard. <br />Morelan stated that another question is whether <br />vacating the street is the right thing to do. Morelan <br />pointed out that if the right-of-way is vacated and <br />given to him, he will have to pay property taxes on <br />that land. <br />Fahey did not believe there was any sense in the City <br />keeping property off the tax rolls if there was no <br />public need for that property. <br />The City Administrator reported that the vacation issue <br />has not been studied, but felt that we could vacate a <br />minimum of 13 feet of right-of-way, retaining 20 feet <br />for a drainage, utility and walkway easement. <br />Morelan suggested that City staff ineet with the <br />individual property workers to see if something can be <br />worked out to improve a 35 foot cul-de-sac at the end <br />of Australian. <br />Pedersen pointed out the two options. The first is the <br />improvement of Jackson Street which makes the most <br />sense from a planning standpoint, but which is opposed <br />by the majority of the neighborhood. The second is the <br />improvement of cul-de-sacs at the ends of Australian <br />and Bluwood. Pedersen asked which option Morelan <br />preferred, and suggested that if the cul-de-saos are <br />the only acceptable option, Mr. Tima could proceed with <br />his lot split application. <br />Morelan replied that depending on how the cul-de-sac <br />affects setbacks for his dividable lot, that is the <br />option which he preferred. Morelan suggested that <br />staff work out the details with the affected property <br />owners. <br />Scalze pointed out that the easement for the Australian <br />cul-de-sac would have to be dedicated at no cost, <br />otherwise the street option is more feasible. <br />21 <br />
