MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 1995 <br />right-of-way will bring it up to the existing 40 foot <br />right-of-way for Australian Avenue which will feed into <br />Jackson Street. <br />Fahey suggested that the matter be tabled for two weeks <br />to give the City Attorney an opportunity to investigate <br />whether a 4/5ths vote or simple majority vote of the <br />Council is required. Fahey stated that it was his <br />understandinq that City Code requires a minimum 50 foot <br />right-of-way for residential streets. <br />Scalze replied that that was correct, but pointed out <br />the discussion of 30 feet for Gilanderi and the <br />existing 40 foot Australian right-of-way. Scalze did <br />not believe 40 feet for Jackson Street appeared to be <br />out-of-line. Scalze felt that was more fair than <br />condemning property for a cul-de-sac. Scalze again <br />pointed out that the property owners in the area were <br />aware of the Jackson Street right-of-way when they <br />purchased their properties. <br />Fahey pointed out that if the area were to be developed <br />today, it would be laid out with two cul-de-sacs rather <br />than a connecting street. <br />Scalze pointed out the development of Aspen Circle and <br />Costa Lane with connecting streets. <br />LaValle suggested that the matter be referred to the <br />City Attorney for comment. <br />Fahey asked if the option of taking the cul-de-sac <br />easement from the Morelan property was open. <br />The Administrator reported that the Morelan's are <br />reluctant about that option given limitations on <br />placing a home on the property should the lot be <br />subdivided. <br />Steve Morelan, addressing the Council as a property <br />owner from the area, reported that he is reluctant to <br />accept that proposal because of the impact on his <br />buildable lot. Morelan indicated that while the road <br />improvement has less impact on the buildable portion of <br />his property, he does have large concerns about the <br />roadway. <br />Fahey pointed out that a lot of staff time has been <br />25 <br />
