Fahey asked Morelan's concerns <br />and how those concerns for the road connection <br />differentiate from the cul-de-sac option. <br />Morelan replied that a through street on a 40-foot <br />right-of-way would push pavement closed to his home. <br />Morelan pointed out that his garage is 20 feet from the <br />easement, even though the Code requirement is for a 30 <br />foot sideyard setback on a corner lot. Morelan felt <br />that if there was adequate area for a 50 foot road <br />right-of-way, he would still not like the road <br />connection, but would have no problem with it. Morelan <br />did not believe the City had good justification for a <br />40 foot right-of-way for Jackson Street other than <br />economics for the City. <br />Fahey stated that what bothers him was putting in a <br />through street to serve the Tima property while <br />impacting the Morelan property by placing a road down <br />its length. Fahey pointed out that the Tima property <br />could be given access via a cul-de-sac, and that the <br />impact of the cul-de-sac on the Morelan property can be <br />minimized with a variance. <br />Scalze pointed out that the pavement within the Jackson <br />Street right-of-way could be offset to keep it as far <br />from the Morelan property as possible. <br />Morelan pointed out that in a typical situation a road <br />pavement is 41 feet from a structure. Morelan stated <br />that he assumed there were good reasons for that <br />distance separation. <br />Fahey asked if the Council was agreeable to granting a <br />variance for the Morelan lot on Australian so that the <br />setback from the cul-de-sac would be no greater than if <br />a through street were put in. <br />Scalze replied that this is a possibility, however, she <br />would like a reply from the City Attorney on the <br />Jackson Street issue. Scalze again pointed out the <br />possibility of offsetting the pavement within the <br />right-of-way. <br />Morelan again pointed out the 41 foot separation and <br />his concern with safety given he has four small <br />children.
