MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 1995 <br />have indicated that they will give the City the right- <br />of-way necessary for the street improvement. <br />Scalze pointed out that that would be a smaller piece <br />than what is necessary for the cul-de-sac. Scalze <br />pointed out that when the Magnuson's purchased their <br />property they were aware that the Jackson Street right- <br />of-way existed. They currently have trouble <br />maneuvering a boat in and out of their property, and <br />that would be resolved if the street were improved. <br />Morelan felt that the Magnuson's should not have <br />assumed a road would be improved on a 33 foot right-of- <br />way. <br />Fahey stated that he would support locating the cul-de- <br />sac in a way that would equally impact the Morelan, <br />Tima, and Magnuson properties, or all on the Morelan <br />property with a variance so that the developable lot is <br />in the same situation as if the street went through. <br />Morelan indicated that if the cul-de-sac option works <br />out setback-wise and a variance is granted so that the <br />lot could be developed in the same manner as it could <br />be today, then he would dedicate the easement at no <br />cost to the City in return for the City's vacating 7 <br />feet of the Jackson Street road right-of-way. <br />The City Planner reported that the subdivision <br />ordinance requires 50 feet of right-of-way for newly <br />platted, residential streets. A variance to this <br />ordinance provision requires a simple majority of the <br />Council. <br />The City Attorney replied that he would verify this <br />information. <br />The City Planner felt that the Planninq Commission <br />should first review a variance from street standards <br />and make a recommendation. <br />Fahey indicated that the issue should be referred to <br />the Planning Commission for a recommendation, and the <br />City Attorney should confirm the Planner's statements <br />about the majority vote. Fahey also suggested that the <br />neighborhood should be advised that the Planning <br />Commission will be considering this issue. <br />27 <br />
