MINUTES <br />CITY COUNCIL <br />APRIL 12, 1995 <br />within the existing right-of-way. <br />The Administrator replied that the proj~~ct is within <br />the existing right-of-way subject to th~=_ issue raised <br />by Mr. Waite. Staff is checking to det~=_rmined whether <br />the corner adjacent to the Waite property is within the <br />right-of-way. The Administrator also puinted out that <br />should the recommendation be made to lower the road <br />grade, a change-order will be presented to the Council <br />for approval. <br />Waite felt that the existing road bed w+~s already on <br />his property. <br />Fahey pointed out that staff will look .into that issue. <br />Waite stated that he felt the City~s as;aessment policy <br />was unfair. Waite pointed out that properties have <br />varying front footages, and felt it unfair to assess <br />based on footage since property owners ~3o not have any <br />more usage of their property. Waite pointed out that <br />his property is a corner lot and he wou.ld have an <br />assessment on his side yard as well as ]zis front yard, <br />even though usage is the same. <br />The Administrator stated that one of th~=_ issues that <br />will be reviewed is whether to assess c~~rner lots based <br />on address or driveway access. <br />Waite pointed out that Keller Parkway r~asidents will <br />have no assessment for the road project in front of <br />their homes since Keller Parkway is a County road. <br />Waite stated that the traffic volummes on Jackson/Old <br />County Road C/Lakeshore were higher than those on <br />Keller Parkway. Waite noted that he wi11 be assessed <br />approximately $8,000 even though he put;a up with more <br />traffic than some County roads. Waite ;suggested that <br />apartment traffic be prevented from uti.Lizing this <br />roadway, or the City charge a toll to those vehicles <br />for use of the road. Waite also suggested that street <br />improvement costs be put on general taxation rather <br />than assessed since all the residents o:E the City have <br />access and use of all its roads. Waite felt that would <br />be a more equitable way of dealing with improvement <br />costs than the one outlined in the stre~~t assessment <br />policy. <br />Fahey thanked Waite for his comments. <br />11 <br />
