However, upon further analysis <br />it appears more feasible to shift the cul-de-sac away <br />from the Greger property, which impacts the Magnuson <br />property less, and the Tima and Morelan properties <br />more. The Tima's and Morelan's would still have the <br />ability to subdivide their properties. The <br />Administrator suggested that right-of-way acquisition <br />could be through cooperative efforts, condemnation, or <br />a combination of the two. <br />Fahey pointed out that at this point the Morelan <br />property is the only one that is dividable since it has <br />frontage on two improved streets. Fahey felt that the <br />Council must consider what is fair as well as the <br />character of the neighborhood. The Tima's could have a <br />lot split, subject to the dedication of the necessary <br />right-of-way easements. Fahey felt that Morelan's <br />would dedicate right-of-way as well. Fahey suggested <br />that City staff could pursue these easements. Fahey <br />also felt that it was unfair to use figures that assume <br />land acquisition costs that may not be involved. <br />LaValle again stated that he wanted the property owners <br />to be clear that the cul-de-sac option was more <br />expensive. <br />Fahey replied that it may not be. <br />LaValle replied that it is more than likely that it <br />will be. <br />Scalze suggested that it may be necessary for the City <br />to hold an improvement hearing. Saalze pointed out <br />that someone must pay the cost of right-of-way <br />acquisition as well as the cost of putting in temporary <br />cul-de-sacs. Scalze pointed out that it was the City <br />which allowed the area to develop as it did without <br />addressing the turn-around situation on both Bluwood <br />and Australian. Scalze also pointed out that it is in <br />the City's best interests to allow the Tima property <br />division and to address the turn-around problems in the <br />neighborhood. Scalze commented that the situation is <br />not the fault of the Tima's. Scalze again suggested <br />that an improvement hearing be held, pointing out that <br />this is the only way the property owners will know the <br />cost of the improvement. <br />11 <br />
