MINUTES <br />CITY COUNCIL <br />APRIL 26, 1995 <br />a city tree ordinance, a comprehensive community <br />forestry program, and an Arbor Day observance. <br />Mayor Fahey proclaimed April 28, 1995 as Arbor Day and <br />the month of May as Arbor Month. Fahey further <br />announced that the City's Arbor Day observance will be <br />held on Saturday, May 6th, at 11 a.m. in Gervais Mill <br />Park. The public is invited to attend, and asked to <br />assist in tree planting efforts that are part of the <br />ceremony. <br />TIMA PROPERTY Fahey reported that the Council has a great deal of <br />DIVISION - information regarding the application for property <br />STREET/ division submitted by Mr. and Mrs. Tima requesting to <br />CUL-DE-SAC divide property at 95 Bluwood into three lots. This <br />ISSUES information includes a recommendation from the Planning <br />Commission on the lot split request as well as on the <br />issue of improvement of Jackson Street versus cul-de- <br />sacs at the ends of Australian and Bluwood. The <br />Council also has copies of letters from property owners <br />in the area stating their opinion on the street versus <br />cul-de-sac issue. <br />Steve Morelan noted that in past discussions of the <br />property division and street/cul-de-sac issues, he has <br />been abstaining from these discussions as a Council <br />Member due to the proximity of his property to the <br />development. Morelan reported that in the past several <br />days, residents have asked him about his voting on the <br />issue. These residents have encouraged him to vote <br />since they did not see that a conflict of interest <br />existed. Morelan stated that it was his understanding <br />from past discussions with the City Attorney on <br />conflict of interest, as well as from seminars which he <br />has attended, that many times the question of whether a <br />conflict exists is not answered until the situation <br />goes to the courts. <br />Morelan reported that he has done a lot of thinking on <br />the issue, and has decided to apply the customer <br />service philosophy he uses to the conflict of interest <br />issue. That is, it doesn't matter if you believe you <br />have given the customer good service, the issue is <br />whether the customer believes it. Therefore, the real <br />issue is whether the people of the community perceive a <br />conflict of interest to exist.
