However, he feels it is in the City's best <br />interests if he continues to abstain from the <br />discussion and voting on this issue as a Council <br />Member. <br />Fahey pointed out that variances from the Subdivision <br />Code would require a simple majority vote of the <br />Council. The issue of the vote for variances from the <br />Zoning Code is still open. Current Code requires a <br />weighted majority, however. <br />The City Planner indicated that this issue does not <br />require a variance from the Zoning Code. Standards of <br />the Zoning Code are met by this proposal regardless of <br />the street design issue. <br />Gary Kajalski, attorney representing Mr. and Mrs. Tima, <br />appeared before the Council. Kajalski pointed out that <br />the Tima's are requesting approval of the subdivision <br />of their property, and have submitted a petition, along <br />with the Magnuson's, requesting the improvement of <br />Jackson Street. Kajalski reported that the City <br />Planner has submitted a report recommending approval of <br />the improvement of Jackson Street versus improvement of <br />cul-de-sacs. The Planning Commission has also <br />recommended the street option. Kajalski asked that the <br />Council make a decision on the street versus cul-de-sac <br />issue so that action can be taken on the property <br />division application. <br />Fahey pointed out that the Council has the benefit of <br />input from the property owners in the <br />Australian/Bluwood neighborhoods which indicates the <br />vast majority prefer the cul-de-sac option to the <br />improvement of Jackson street. <br />Steve Morelan, property owner at 109 Bluwood, appeared <br />before the Council. Morelan indicated that he wanted <br />to thank the staff for their handling of this matter, <br />pointing out that staff gave him no special treatment <br />and he was treated as any other citizen would have <br />been. Morelan also reported that he has not lobbied <br />Council Members on the issue. A couple of the Council <br />Members have called and asked him questions, which he <br />answered, but he has made no phone calls to the Members <br />on this issue. <br />Morelan reported that he has no problem with Mr. Tima <br />3 <br />
