Fahey stated that the property owner <br />which will benefit the most are the Tima's who will <br />gain two extra lots which under the ordinance they have <br />no legal right to ask for. Fahey suqgested that the <br />Council move forward with the property division subject <br />to approval of the cul-de-sac option. The actual <br />improvement of the cul-de-sacs could be deferred until <br />Bluwood and Australian are reconstructed. Fahey again <br />pointed out that the cul-de-sac improvement would <br />preserve the character of the neighborhood. Fahey <br />suggested that City staff can negotiate with the <br />property owners to get the proper placement of the <br />Australian cul-de-sac. If necessary, the City can use <br />eminent domain to get the right-of-way for the <br />Australian cul-de-sac. <br />LaValle pointed out the recommendation for a 35-foot <br />radius cul-de-sac on Australian given the limited <br />right-of-way in that area. However, there is 90 feet <br />of right-of-way at the end of Bluwood. Therefore, <br />LaValle felt that a standard-sized cul-de-sac should be <br />improved at the end of Bluwood. Under that scenario, <br />the cost of the cul-de-sac option would increase, thus <br />the assessment cost to property owners would increase. <br />Fahey stated that the City should try to meet the <br />City~s requirements to the extent it can, therefore, he <br />favored a standard-sized cul-de-sac on Bluwood. On <br />Australian the situation is more restricted, and a 35 <br />foot radius right-of-way for the cul-de-sac is <br />appropriate. <br />LaValle reported that he discussed the situation with <br />the City Administrator, who indicated that it will take <br />some time to put more exact numbers together for the <br />cul-de-sac improvement. Those numbers would include <br />estimated land acquisition costs as well as <br />condemnation costs. LaValle indicated that on <br />Australian the cul-de-sac should be shifted so that it <br />impacts all four properties at the end of the street <br />equally. <br />Scalze aqreed that the cost of the cul-de-sac <br />improvement was still a variable. Scalze felt that the <br />property owners in the area should be made aware of the <br />cost of the cul-de-sac improvement, and that <br />condemnation will increase the cost. 5calze was <br />concerned with taking property from owners who do not <br />9 <br />
