MINUTE5 <br />CITY COUNCIL <br />MAY 10, 1995 <br />VACATED FROM THE JACKSON STREET RIGHT-OF-WAY, WHICH <br />WILL LEAVE 26 FEET OF RIGHT-OF-WAY REMAINING, SUBJECT <br />TO THE MAGNUSON'S DEDICATING AN 8 FOOT DRAINAGE AND <br />UTILITY EASEMENT ALONG THEIR SOUTHERN PROPERTY LINE AT <br />THE COST OF $250.00 TO THE CITY, AND SUBJECT TO THE <br />CITY REPLACING WITH LIKE KIND ANY TREES ADJACENT TO THE <br />STORM SEWER LINE THAT ARE IRREPARABLY DAMAGED OR THAT <br />DIE WITHIN TWO YEARS OF STORM SEWER CONSTRUCTION, WITH <br />STORM SEWER IMPROVEMENTS TO BE MADE WITHIN TFIIS <br />EASEMENT DURING THE 1995 IMPROVEMENT SEASON AND AT CITY <br />COST PURSUANT TO CURRENT STREET CONSTRUCTION POLICIES <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) LaValle, Scalze, Pedersen, Fahey. <br />Nays (O). <br />Abstentions (1) Morelan. Resolution declared adopted. <br />Fahey suggested that the City Engineer look at the <br />possibility of a temporary gravel cul-de-sac at the end <br />of Bluwood as well as Australian. <br />The City Administrator reported that it would be his <br />recommendation that only Australian be addressed at <br />this time since there have not been the complaints <br />about turning around on Bluwood that there have been on <br />Australian. <br />Scalze stated that she wants it part of the record that <br />the cul-de-sac at the end of Bluwood will be improved <br />with a 45 foot radius right-of-way and 40 foot radius <br />pavement at the time the street is reconstructed. <br />Fahey stated that that issue has not been resolved as <br />yet. <br />Scalze felt that the settlement of the Australian issue <br />was contingent upon the understanding of the cul-de-sac <br />size on Bluwood. Scalze pointed out that there is <br />adequate right-of-way for the 45 foot radius right-of- <br />way with a 40 foot radius pavement. <br />Morelan stated that he did not know that the Bluwood <br />neighborhood discussed the 40 foot radius pavement. <br />Fahey stated that he did not believe the City should <br />construct a sub-standard cul-de-sac when there is <br />adequate right-of-way to put in the standard. Fahey <br />pointed out that in the Australian cul-de-sac will be <br />substandard because of the lack of room. <br />Mrs. Scalze introduced the following resolution and <br />5 <br />
