MINUTES
CITY COUNCIL
MAY 24, 1995
curve will increase traffic speeds.
Scalze asked if the road can be shifted over and still
remain within the existing right-of-way.
The City Administrator replied that the road can be
shifted to the southeast and still remain within the
right-of-way. The Administrator suggested that staff
meet with the property owners across the street to
explain the change.
Morelan asked the pros and cons of shifting the road.
Fahey pointed out that the City can either shift the
road or condemn a snow storage easement from Mr. Waite.
Fahey suggested that when there is adequate road right-
of-way, the City should not take condemnation action.
The City Administrator stated that staff felt
maintaininq the existing radius on the curve was a
better situation. Until this evening there was no
indication from Mr. Waite that he would not grant the
snow storage easement. Waite had indicated that he
would consider granting the easement, and would get
back to the Administrator on this issue.
It was the consensus of the Council to shift the road
at the corner of Lakeshore/Old County Road C to the
southeast to avoid the necessity of a snow storage
easement from Mr. Waite.
NUISANCE The Council reviewed the amendment to the Nuisance
ABATEMENT Ordinance submitted by the City Attorney which
ORDINANCE minimizes the Council~s involvement in enforcement of
the Code relating to violations of this ordinance.
Mr. LaValle introduced the following ordinance and
moved its adoption:
ORDINANCE NO. 413 - AMENDING SECTIONS 601.070 AND
601.080 OF THE MUNICIPAL CODE OF THE CITY OF LITTLE
CANADA RELATING TO ABATEMENT OF NUISANCES
The foregoing ordinance was duly seconded by Scalze.
Ayes (5) LaValle, Scalze, Pedersen, Morelan, Fahey.
Nays (0).
