MINUTES
CITY COUNCIL
JUNE 13, 1995
property, the City could re-assess it subject to the
125 foot maximum lot frontage.
Fahey suggested that City staff look at the issue and
bring back a recommendation to the Council at its next
meeting.
Moravetz believed that the assessment was waived for
the 30 feet since it was not a buildable lot.
Fahey pointed out that by attaching the 30 feet to the
Moravetz lot, it becomes part of a buildable piece,
therefore, the assessment should be attached.
The Administrator reported that the assessment for
Allen Avenue was approximately $43.00 per front foot.
Fahey pointed out that at a maximum an additional
$1,200 in assessment would be due. Fahey again pointed
out that the 125 foot lot width maximum would apply as
well in calculating the assessment rate.
Moravetz reported that he currently has 84 feet of
frontage on Allen Avenue, and is looking to add the
additional 30 feet. Moravetz reported that he has
already purchased Lot C, and would like to combine it
with his adjacent property.
Fahey noted that this poses the potential to assess the
30 feet since it would become part of a buildable lot.
Fahey also noted that the assessment amount would be
spread over property taxes.
The Administrator suggested that a supplemental
assessment hearing may have to be held. The
Administrator suggested that he review the facts with
Mr. Moravetz and come back to the Council with a
recommendation.
Mrs. Scalze introduced the following resolution and
moved its adoption:
RESOLUTTON NO. 95-6-148 - INSTRUCTING THE CITY ATTORNEY
TO PREPARE THE NECESSARY DOCUMENTS LIFTING THE
UNBUILDABLE STATUS OF LOT C, R.L.S. 512, PROVIDED THAT
TIIIS LOT BE COMBINED WITH THE ADJACENT PROPERTY OWNED
BY MR. MILAN MORAVETZ, AND SUBJECT TO TIIE ADMINISTRATOR
WORKING OUT A RESOLUTION TO THE MATTER OF ALLEN AVENUE
ASSESSMENTS FOR THE 30-FOOT LOT
2
