MINIITES <br />CITY COUNCIL <br />JUNE 13, 1995 <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Scalze, Morelan, Fahey, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />Moravetz asked if he would withdraw his request to <br />combine the property, would the lot not be assessed? <br />The City Administrator suggested that he provide Mr. <br />Moravetz with the facts. Mr. Moravetz can review those <br />facts and if an agreement cannot be reached, present <br />his position to the City Council at their next meeting. <br />CONSENT Council reviewed items on the consent agenda. Morelan <br />AGENDA - reported that he has heard complaints from parents <br />Blue Bell about ice cream vendors operating during the dinner <br />Vendors hour. Morelan suggested that the Blue Bell vendors <br />License license be restricted and the trucks not allowed to <br />sell between the hours of 5 P.M. and 6 P.M. <br />The consensus of the Council was not to support this <br />restriction, with Fahey indicating that it was a matter <br />of parents~ exercising control. <br />Maintenance Council reviewed the joint powers agreement with <br />Materials Ramsey County for maintenance materials recycling. <br />Recyclinq LaValle expressed concern that it appears the City has <br /> no control over expenses under the agreement. LaValle <br /> pointed out discussion of the user fee on page 15 of <br /> the agenda packet, pointing out that there is no limit <br /> to the user fee. LaValle also suggested the fee could <br /> be affected by the location of the recycling site. <br /> LaValle was also concerned about the termination clause <br /> in the agreement. <br /> The City Attorney pointed out that the agreement term <br /> is five-years, and there may be some reimbursement <br /> responsibility if termination occurs before five years. <br /> The Attorney stated that he was not sure about the <br /> affect of operating costs on the City. <br /> Fahey suggested that the matter be tabled for two weeks <br /> pending further analysis of the user fee. Fahey noted <br /> that the amount of the fee appears to depend on actual <br /> cost of $1.50 per ton plus location of recycling site. <br /> Mr. Fahey introduced the following resolution and moved <br /> its adoption: <br />RESOLUTION NO. 95-6-149 - REMOVING THE JOINT POWERS <br />AGREEMENT WITH RAMSEY COUNTY FOR MAINTENANCE MATERIALS <br />RECYCLING FROM THE CONSENT AGENDA, AND TABLING ACTION <br />3 <br />
