MINUTES
CITY COUNCIL
JIJNE 28, 1995
along Rice Street should be made non-conforming.
Fahey questioned Section 910.040. C. Commercial Planned
Unit Development as regulated by Section 923. The City
Planner replied that a commercial PUD in a B-3 District
would only encompass permitted or conditional uses
allowed in the B-3 District.
Fahey pointed out that the consensus is that the only
conditional use in the B-2 District that would roll
over into the B-3 District would be drive-in and
convenience food establishments. Council agreed.
It was also the consensus of the Council to eliminate
Section 912.040. C., convenience gas, grocery, and/or
food operations from the list of conditional uses
allowed in the B-3 District.
Carl Schroeder, Sr. expressed concern about this
action.
Fahey pointed out that it is the feeling of the Council
that there is sufficient development of this nature
alonq Rice Street.
Morelan pointed out that should a property owner with
B-3.property wish to develop a gas station/convenience
store, they would have to request a rezoning to B-2.
Schroeder objected to elimination of this conditional
use from the B-3 District. Schroeder questioned the
Council's expertise and experience to judge whether
there was too much development of a certain kind along
Rice Street.
Morelan stated that he did not totally disagree with
Schroeder's comments, and suggested that market factors
would have to be considered. Morelan pointed out that
gas stations/convenience stores along Rice Street would
serve a region, not just Little Canada. Therefore,
market studies would be based on a region and not
limited to the City.
Schroeder pointed out that Rice Street has been
restriped to handle heavier traffic volummes.
Schroeder felt that to develop the Rice Street strip
with businesses other than auto-related was
questionable. Schroeder reported that he has had
several requests to develop his Rice Street property
with a gas station/convenience store. Schroeder felt
that auto-related was the way to develop his site.
Schroeder also stated that he was open to suggestions
5
