MINUTES <br />CITY COUNCIL <br />JIJNE 28, 1995 <br />along Rice Street should be made non-conforming. <br />Fahey questioned Section 910.040. C. Commercial Planned <br />Unit Development as regulated by Section 923. The City <br />Planner replied that a commercial PUD in a B-3 District <br />would only encompass permitted or conditional uses <br />allowed in the B-3 District. <br />Fahey pointed out that the consensus is that the only <br />conditional use in the B-2 District that would roll <br />over into the B-3 District would be drive-in and <br />convenience food establishments. Council agreed. <br />It was also the consensus of the Council to eliminate <br />Section 912.040. C., convenience gas, grocery, and/or <br />food operations from the list of conditional uses <br />allowed in the B-3 District. <br />Carl Schroeder, Sr. expressed concern about this <br />action. <br />Fahey pointed out that it is the feeling of the Council <br />that there is sufficient development of this nature <br />alonq Rice Street. <br />Morelan pointed out that should a property owner with <br />B-3.property wish to develop a gas station/convenience <br />store, they would have to request a rezoning to B-2. <br />Schroeder objected to elimination of this conditional <br />use from the B-3 District. Schroeder questioned the <br />Council's expertise and experience to judge whether <br />there was too much development of a certain kind along <br />Rice Street. <br />Morelan stated that he did not totally disagree with <br />Schroeder's comments, and suggested that market factors <br />would have to be considered. Morelan pointed out that <br />gas stations/convenience stores along Rice Street would <br />serve a region, not just Little Canada. Therefore, <br />market studies would be based on a region and not <br />limited to the City. <br />Schroeder pointed out that Rice Street has been <br />restriped to handle heavier traffic volummes. <br />Schroeder felt that to develop the Rice Street strip <br />with businesses other than auto-related was <br />questionable. Schroeder reported that he has had <br />several requests to develop his Rice Street property <br />with a gas station/convenience store. Schroeder felt <br />that auto-related was the way to develop his site. <br />Schroeder also stated that he was open to suggestions <br />5 <br />
