MINUTES <br />CITY COUNCIL <br />JiJNE 28, 1995 <br />Fahey pointed out that an auto accessory store would be <br />a permitted use, however, auto body was not. <br />Newman asked if an oil change or muffler store would be <br />permitted. Newman pointed out that the site is highly <br />visible from Highway 36, and the location is most <br />advantageous for this type of use. <br />Fahey replied that vehicle service or repair would not <br />be permitted if the Council takes action amending the <br />uses allowed in the B-3 District. <br />The City Planner reported that auto repair-minor and <br />tire and battery stores are conditional uses in the B-2 <br />District. Should the Council act to prohibit these <br />uses from rolling over into the B-3 District, a <br />property owner would have to request a rezoning to B-2. <br />Morelan suggested that he would be willing to consider <br />a rezoning of a site along Viking Drive from B-3 to B-2 <br />to allow this type of use. <br />Newman stated that he can understand the Council's <br />desire to control development along Rice Street. <br />Aowever, Newman felt what occurs along Viking Drive was <br />inconsequential. Newman asked if auto body repair <br />would be permitted. <br />Scalze pointed out that auto body repair is only <br />allowed in industrial areas. Auto body repair is <br />neither a permitted nor conditional use in the business <br />districts. <br />Fahey reported that the decision to restrict auto body <br />repair to industrial areas was made at the time the <br />City adopted its Comprehensive Plan. It is highly <br />unlikely that the City would rezone Rice Street or <br />Viking Drive properties to industrial. <br />Newman asked what is permitted in the business <br />districts. <br />Fahey reviewed the permitted uses for the B-l, B-2 and <br />B-3 Districts. <br />Fahey suggested that Convenience Gas be eliminated as a <br />Conditional Use in the B-3 District, and that the <br />remaining conditional uses in the B-3 District be <br />allowed to remain. <br />Fahey pointed out that the City has had a moratorium on <br />7 <br />
