MINUTES <br />CITY COUNCIL <br />JUNE 28, 1995 <br />ORDINANCE NO. 415 - AN ORDINANCE AMENDING SECTION 912 <br />OF THE LITTLE CANADA ZONING ORDINANCE RELATING TO THE <br />CONDITIONAL USES IN THE "B-3", GENERAL BUSINESS <br />DISTRICT~ PROHIBITING THE ROLLING OVER OF CONDITIONAL <br />USES FROM THE B-2 DISTRICT TO B-3 WITH THE EXCEPTION OF <br />SECTION 911.040. A., DRIVE-IN AND CONVENIENCE FOOD <br />ESTABLISHMENTS, AND STRIKING SECTION 912.040. C. <br />CONVENIENCE GAS~ GROCERY AND/OR FOOD OPERATIONS A5 A <br />CONDITIONAL USE IN THE B-3 DISTRICT <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, Pedersen, LaValle. <br />Nays (0). Ordinance declared adopted. <br />Morelan pointed out that existing gas <br />stations/convenience stores in the B-3 District are now <br />non-conforming. Morelan suggested that this use be <br />added to the B-2 District. <br />The City Planner pointed out that convenience grocery <br />stores are a permitted use in the B-1 District and <br />motor fuel stations are a conditional use in the B-2 <br />District. Therefore, a gas station/convenience store <br />would be allowed as a conditional use in the B-2 <br />District through a combination of the two uses. <br />55 PLUS CLUB Council reviewed the request submitted by the 55+ <br />FUNDING Club for funding of an anniversary celebration <br />REQUEST planned by the Club. The City Administrator had <br />concerns about the appropriateness in using public <br />funds for this type of event and recommended the <br />request be denied. Scalze pointed out that similar <br />requests have been denied in the past due to this same <br />concern. The Council asked the City Administrator to <br />inform the 55+ Club of the Council's position on this <br />matter and offer any assistance the City might offer in <br />contacting other funding sources. <br />CONSENT LaValle stated that he had concerns with the Joint <br />AGENDA Powers Agreement for recycling of maintenance materials <br />which is on the Consent Agenda. LaValle stated that it <br />was not clear to him whether or not the City will be <br />exposed to additional costs as a result of entering <br />into this agreement. LaValle asked the costs for <br />transporting materials. He also asked how obligated <br />the City was to the five year term of the agreement. <br />LaValle pointed out that the City currently has a <br />business in town that performs this service. <br />9 <br />
