MINUTES <br />CITY COUNCIL <br />JULY 26, 1995 <br />property owner on Lake Gervais, regarding a safety <br />concern on the lake with water craft coming too close <br />to the beach area. Forbes also expressed concern about <br />noise and water skiers. The Administrator reported <br />that Lt. Bergeron of the Sheriff's Department is <br />proposing a no wake zone for the southwest bay of the <br />lake, which encompasses the beach area. <br />The Administrator reported that he has discussed the <br />adoption of these regulations with staff at the DNR who <br />indicated that since Gervais lies in multiple <br />jurisdictions, Maplewood would have to adopt the no <br />wake zone as well. The public hearing process would <br />have to be followed in both cities in order to enact no <br />wake regulations. Once adopted by the cities, the <br />regulations would not become effective until the DNR <br />has reviewed and approved them. <br />Scalze pointed out that due to the length of the <br />process, it is likely the matter wouldn't be resolved <br />this summer. <br />Morelan asked if boaters coming dangerously close to <br />the beach were violating any existing regulations. <br />Morelan suggested that perhaps the problem was with <br />enforcement. <br />The Administrator replied that there are regulations <br />prohibitinq boats from coming within 100 feet of <br />swimmers. However, there is also a problem with the <br />wake caused by boats knocking down toddlers. It was <br />felt that placement of buoys marking the no wake zone <br />would give good notice to boaters and minimize the <br />problem. <br />LaValle suggested that staff discuss the issue with <br />Maplewood staff to determine the likelihood of their <br />adopting a no wake zone. LaValle also pointed out that <br />the City of Arden Hills has restricted horsepower, boat <br />speed and hours of operation on Lake Johanna. LaValle <br />suggested that perhaps the City should consider some <br />additional regulations. <br />The City Administrator reported that the DNR was going <br />to forward information on other options. However, this <br />information has not been received as yet. <br />Scalze felt that the no wake zone was easiest to <br />enforce. She also felt that this approach would be <br />more acceptable to property owners on the lake than <br />placing a lot of restrictions on speeds and horsepower. <br />7 <br />
