MINUTES <br />CITY COUNCIL <br />AUGUST 9, 1995 <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-8-186 - APPROVING AND ACCEPTING TIIE <br />GILANDERI/VIKING DRIVE IMPROVEMENT EASEMENT AGREEMENTS <br />AND DECLARATION OF COVENANTS, CONDITIONS AND <br />RESTRICTIONS SUBJECT TO UNANIMOUS EXECUTION ON THE PART <br />OF THE AFFECTED PROPERTY OWNERS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Morelan, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />NO WAKE ZONE- Fahey pointed out that the City of Maplewood has <br />GERVAIS LAKE indicated that designation of the southwest bay of <br />Gervais Lake was a good idea subject to citizen <br />reaction. Fahey felt that the City should not proceed <br />with a restriction on the lake unless a public hearing <br />is held to gather input. Fahey also indicated that he <br />would be interested in hearing reaction to a less <br />restrictive option, feeling that a no wake zone for the <br />southwest bay of the lake may be over-reaching. Fahey <br />pointed out that if the problem is centered around the <br />swimming beach, perhaps an option would a no wake <br />restriction during the summer when the beach is in <br />operation. If the reason for the no wake zone is <br />because of noise on the lake, Fahey questioned what <br />benefit imposing a no wake zone on a portion of the <br />lake will have on a noise problem. Fahey also stated <br />that it would not be fair to restrict one area of the <br />lake because of a noise problem on the entire lake. <br />Pedersen pointed out that the proposal is to impose a <br />no wake zone for the entire calendar year. Pedersen <br />asked the effect on snowmobiles. <br />The City Administrator pointed out that the DNR's Water <br />Surface Use Rules and Statutes provides options for <br />time periods of enforcement. <br />Fahey felt the sunrise to sunset option for the summer <br />months would best coincide with the time period that <br />the beach is open. Fahey also pointed out that if the <br />problem has to do with noise, the City has a noise <br />ordinance that would extend to the lake as well as City <br />streets. Fahey felt that any restrictions on the lake <br />should be narrowly proposed, if at all. The City <br />should have some pretty solid grounds for imposing <br />restrictions on the lake. <br />Scalze agreed. <br />5 <br />
