MINLJTES <br />CITY COUNCIL <br />AUGUST 9, 1995 <br />Morelan stated that he still has some reservation about <br />doing anything, and felt that public input from the <br />property owners abutting the lake was important. <br />Morelan felt that the issue tonight was whether the <br />proposal had enough merit to warrant going through the <br />public hearing process. <br />Fahey asked what other cities have done, and asked <br />whether the problem has been a big enforcement issue? <br />Has the City received a lot of complaints or just one <br />complaint? <br />The City Administrator replied that there have been <br />sporadic complaints. However, the request for the no <br />wake zone comes from the Ramsey County Sheriff's <br />Department due to concerns about safety at the swimming <br />beach. <br />LaValle pointed out that the same situation exists on <br />White Bear Lake, and the City has a no wake zone <br />adjacent to the beach area. <br />Fahey stated that if the reason for the no wake zone is <br />a safety issue, he sees no reason for a public hearing <br />because of the need to act on a public safety basis. <br />Scalze pointed out that restrictions cannot be placed <br />on the lake without approval of the City of Maplewood <br />as well as the DNR. The DNR requires that a public <br />hearing process be followed before they will approve an <br />ordinance. Scalze stated that she received a call <br />expressing concern that posting a no wake zone on the <br />southwest end of the lake will transfer problems to <br />other areas of the lake. Scalze reported that she <br />assured the caller that a public hearing would be held <br />on the issue. <br />Fahey felt the DNR would not approve a no wake zone for <br />the entire lake since Gervais is a public lake with <br />public access. Fahey pointed out that the problems <br />exists because of a few individuals speeding around the <br />beach area. <br />Scalze reported that she heard problems are occurring <br />because of the launching of boats at the picnic area <br />near the beach. <br />LaValle replied that boats <br />access, but beached by the <br />going from there. <br />are launched at the public <br />picnic area and coming and <br />Morelan stated that the City must address the safety <br />6 <br />
