MINUTES <br />CITY COUNCIL <br />AUGUST 23, 1995 <br />is not required. Bill's Automotive reported that he <br />has acquired a few cars which have been sitting on the <br />site. These cars will be removed from the property. <br />Fourre reported that he is not objecting to the cars <br />which sit on the property for a few days, but rather <br />the ones that have been sitting for a long time. There <br />is also a trailer without wheels and a truck sitting on <br />the site. Fourre stated he was concerned about the <br />berm extending beyond Mr. Frattalone's property line <br />since this would provide more area for outdoor storage. <br />Fourre was concerned that filling has occurred in the <br />drainage area. <br />Frattalone replied that there has been no filling of <br />the swamp. <br />The Code Officer also pointed out that the property is <br />zoned B-3. There is a major motor vehicle repair shop <br />operating in the building. This is not a permitted use <br />in the B-3 District. The Code Officer stated that he <br />needed to do more research on the businesses in the <br />building to determine which are permitted and which are <br />not. <br />Fahey pointed out that this was an issue a few years <br />ago, and there was a lawn care business which had to <br />relocate since it was not permitted. <br />Frattalone stated that he believed all the businesses <br />in the building were licensed. <br />Bill's Automotive reported that he moved into the <br />building in 1989 or 1990 and was issued a license by <br />the City. <br />The City Administrator reported that Bill's Automotive <br />is an auto wholesaler which is a permitted use for <br />indoor activity only. L& R Automotive, which is the <br />major automotive repair business, is not licensed by <br />the City. <br />L& R indicated that they did minor auto repair, not <br />major. <br />The Planner pointed out that minor auto repair requires <br />a Conditional Use Permit in the B-2 District, and is <br />not allowed in B-3. <br />Scalze pointed out that there is a footage separation <br />requirement between car dealers. <br />19 <br />
