MINU'PES
CITY COUNCIL
SEPTII~SBER 13, 1995
The foregoing resolution was duly seconded by Scalze.
Ayes (5) Morelan, Scalze, Fahey, Pedersen, LaValle.
Nays (O). Resolution declared adopted.
ST. JUDE The City Administrator reported that the State is
MEDICAL turning back two parcels of land which are right-of-
VACATION way for Viking Drive to the City. St. Jude Medical
REQUEST is requesting the vacation of one of these parcels in
order that they might construct a new sign at their
facility on this property. The Administrator reported
that there are compensation issues to consider
especially in light of the fact that Viking Drive is a
single-frontage street. When that street is
reconstructed, there is only one side of the street
which can be assessed. The Administrator suggested
that it may be possible to define a small parcel to be
vacated back to St. Jude to accommodate their sign
plans, and then deal with the compensation issue for
the rest of the property at a later date.
Morelan asked if a small piece could be vacated without
subdividing it.
The Administrator agreed that the City may have to
subdivide.
LaValle asked if St. Jude Medical would be interested
in buying the entire piece of property.
The Administrator replied that that is a possibility,
but not his proposal tonight. The Administrator
suggested that in order to accommodate St. Jude's
desire for a new sign, he is suggesting that a small
piece be vacated for the sign. The transfer of a small
parcel should not effect the buildability of the rest
of the parcel.
Scalze suggested that at this point the City let St.
Jude erect the sign on the right-of-way.
The Administrator replied that the Zoning Ordinance
requires that a business sign is located on property
owned by the business.
Pedersen pointed out that St. Jude Medical is not a
sign-dependent business. Therefore, action on the
matter could be delayed until details of the purchase
are worked out.
Scalze felt that the vacated right-of-way should become
22
