MINUTES <br />CITY COUNCIL <br />DECEt4BER 6, 1995 <br />for sale, State Statutes provide that the property <br />owner can enter into a waiver of relocation benefits. <br />The Attorney pointed out the proposal submitted by <br />Evergreen Land Services Company to provide acquisition <br />and relocation services for two parcels in the Rice <br />Street/Little Canada Road area. The Attorney pointed <br />out that these services would include fairly extensive <br />work in giving notices to property owners and providing <br />complete disclosure of all relocation benefits. All of <br />this is based on the Uniform Relocation Assistance Act <br />adopted by the Federal Government in March of 1989. <br />The Attorney reported that he is not sure that the <br />property owners of the parcels indicated intend to sell <br />their property to the City or have put the parcels on <br />the market for sale. If this is the case, it opens the <br />door to waivers of benefits. <br />The Attorney reported that his experience with a firm <br />like this is that they provide a service independent of <br />the acquiring authority. This firm would provide an <br />impartial position in the process. The firm can tell <br />the property owner what the law is and tell the owner <br />what his/her riqhts are. <br />Morelan asked if the City is required to educate the <br />property owner on his/her rights. <br />The City Attorney replied that that was correct. <br />Fahey again stated that the City has a full plate at <br />this time with the Market Place and Rutzick proposals, <br />and suggested that any redevelopment efforts directed <br />toward the Guerin property be placed on hold. <br />Fifield pointed out that the City has created a <br />Development Guide which deals with the entire Rice <br />Street/Little Canada area. There is also the Country <br />Drive area to consider. There are properties in both <br />these areas that could generate redevelopment <br />proposals, and there are other land acquisitions that <br />the City could be faced with. <br />Fahey suggested that there is no need to move forward <br />on the Guerin property until the property is on the <br />market. <br />The City Administrator pointed out that the Council has <br />talked about acquiring properties in the past, <br />therefore, must be aware of what will trigger <br />relocation benefits.
