MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 1996 <br />mortgage, and he intended to refinance his home. <br />Rather than refinance the entire property, he is <br />proposing the subdivision so the new lot would not be <br />mortgaged. L'Allier indicated he intended to sell his <br />existing home in 10 to 15 years and would then <br />construct a new home on the lot. <br />Fahey stated that one well cannot be used to provide <br />water to two houses. Fahey indicated the lot split can <br />be approved with the understanding that L'Allier would <br />not contest a future water main assessment. <br />L'Allier indicated he would not waive his rights for an <br />assessment of $14,900 as estimated by the City Engineer <br />for a connection to the existing water main near his <br />property. However, he would be willing to waive his <br />riqhts for a $2,000 assessment. <br />Fahey indicated this is the typical agreement the City <br />requires for a property division where City water main <br />is not available. Fahey suggested if L'Allier is <br />uncomfortable with signing the Waiver, he wait to <br />divide his property until water main is installed on <br />Viking Drive. Fahey pointed out that without the <br />Waiver, when a water main improvement is proposed, <br />L'Allier could oppose the improvement to the detriment <br />of his neighbors who might want water. Fahey noted <br />that the City Engineer and Public Works Director have <br />indicated it would not be practical to require L'Allier <br />extend water main to serve his two lots at this time, <br />but to wait for a larger project. This would result in <br />a much lower cost for L'Allier. <br />L'Allier again indicated he would sign a Waiver for <br />$2,000. <br />Fahey indicated the City cannot give L'Allier assurance <br />that the cost of a water main project to his lots would <br />be limited to $2,000. Assessment of the L~Allier <br />property would be on the same basis as other properties <br />in the area. Fahey pointed out should L'Allier sell <br />his property, without the Waiver, the new owner could <br />oppose a water main improvement on Viking Drive. <br />L'Allier indicated that even if he did not sign a <br />Waiver and objected to a water main improvement on <br />Viking Drive, the City would not let him stand in the <br />way of the improvement.
