MINUTES <br />CITY COUNCIL <br />MAY 22, 1996 <br />the future. <br />The City Attorney replied that the application is for a <br />Conditional Use Permit for a new garage. Conditions <br />placed on the CUP must be relative to the construction <br />of the new structure. If the existing garage meets <br />Code, then conditions cannot be placed on that <br />structure. <br />The City Planner pointed out, however, that if the <br />existinq garage needs to be replaced in the future, <br />another CUP would need to be applied for. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 96-5-117 - APPROVING A CONDITIONAL USE <br />PERMIT FOR SECOND ACCESSORY BUILDING RESULTING IN TOTAL <br />ACCESSORY SPACE OVER 1,000 SQUARE FEET FOR PROPERTY <br />LOCATED AT 2947 CENTERVILLE ROAD SUBJECT TO COMPLIANCE <br />WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS <br />OUTLINED IN HIS REPORT DATED APRIL 8, 1996 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Morelan, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />PRELIMINARY Fahey opened the public hearing to consider the <br />PLAT - preliminary plat for Stoneridge Addition, a plat <br />STONERIDGE consisting of nine (9) single-family residential lots. <br />ADDITION Fahey pointed out that both the Planning Commission and <br />City Planner have recommended approval of the <br />preliminary plat. The City Engineer also recommended <br />approval subject to compliance with the conditions <br />outlined in his letter dated May 16, 1996. <br />The City Administrator pointed out that the Council can <br />approve the preliminary plat subject to approval of <br />plans and specifications prior to final plat approval. <br />The Administrator noted that the developer would be <br />required to enter into a development agreement with the <br />City. <br />Scalze asked the location of the walking path which <br />would connect the end of the cul-de-sac to the City's <br />park property. <br />The Planner replied that the path would be located <br />between Lots 5 and 6. It was noted that the developer <br />will be responsible for paving a 6-foot wide path over <br />3 <br />
