MINUTE5 <br />CITY COUNCIL <br />JUNE 26, 1996 <br />ZONING CODE <br />RELATIVE TO <br />PUD USES <br />Commission has recommended approval of the amendment. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Morelan, seconded by Scalze, the public <br />hearing was closed. <br />Council noted that the amendment would list the <br />following uses as not being allowed in the PUD <br />District: Motor Fuel Stations, Automobile Repair - <br />Major, Automobile Repair - Minor, Motor Vehiole Sales <br />Lots, Car Washes, and Motor Vehicle Tire and Battery <br />Service. <br />The City Administrator reported while some people have <br />the impression that this amendment is a backdoor <br />approach to restricting these auto-related uses, it has <br />always been the intent of the City to restrict these <br />uses from the PUD District in a manner consistent with <br />the B-3 restrictions enacted last year. This <br />limitation was also discussed at the time of the <br />enactment of the PUD District in the Rice Street and <br />Little Canada Road area, but our existing Comp Plan <br />does not provide sufficient grounds to limit uses as <br />originally contemplated. This Zoning District <br />amendment brings the District into conformance with <br />this intent. <br />Fahey agreed, and noted that the action makes the <br />intent clear in the text of the PUD District. <br />Mr. Morelan introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE N0. 438 - AMENDING SECTION 915 OF THE LITTLE <br />CANADA CITY CODE KNOWN AS THE ZONING ORDINANCE, BY <br />AMENDING THE PLANNED UNIT DEVELOPMENT (PUD) DISTRICT TO <br />EXCEPT CERTAIN USES FROM THE DISTRICT <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />TOBACCO The Council reviewed the information provided by staff <br />REGULATIONS summarizing restrictions which other cities have <br />imposed on the sale of tobacco products. Morelan <br />sugqested that the City consider imposing the following <br />restrictions: <br />27 <br />
