MINUTES <br />CITY COUNCIL <br />AUGUST 28, 1996 <br />staff would notify property owners of the nuisance and <br />provide them with a reasonable amount o£ time to <br />correct the situation. <br />Mr. Morelan introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 443 - AN ORDINANCE AMENDING SECTION <br />601.050(K) OF TI-IE MUNICIPAL CODE OF THE CITY OF LITTLE <br />CANADA, RELATING TO PUBLIC NUISANCES AFFECTING HEALTH <br />AND SAFETY <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Pedersen, Fahey, LaValle. <br />Nays (0). ordinance declared adopted. <br />RIGHT OF The City Attorney submitted an ordinance which allows <br />ENTRY AND law enforcement and code enforcement personnel right <br />TRAFFIC of entry into mobilehome parks within the City. The <br />ENFORCEMENT Attorney indicated that these personnel already have <br />IN the right of entry, however, staff would be more <br />MOBILEHOME comfortable having this ordinance on the books. The <br />PARKS Attorney also reported that the Sheriff's Department <br /> has requested authority to enforce traffic laws on <br /> private property, and the proposed ordinance also <br /> addresses that issue. <br /> Morelan clarified that the City already has the right <br /> of entry and traffic enforcement authority, this <br /> ordinance merely clarifies those rights. <br /> The City Attorney replied that that is correct, except <br /> for DUI and reckless drivinq. Those offenses are <br /> enforceable under Statute 327. <br />Denise Moore, representing the ownership of North Star <br />Estates Mobilehome Park, asked the purpose of the right <br />of entry ordinance. <br />Fahey indicated there is no question the Ramsey County <br />Sheriff's Department can come into the mobilehome park <br />and enforce Codes and general traffic regulations. <br />This ordinance merely clarifies that authority. <br />Moore reported she has eight parks under her <br />jurisdiction, and she would welcome law enforcement in <br />each park. Moore asked if adoption of the ordinanoe <br />obligated the Sheriff~s Department to come in and <br />enforce laws. Moore reported that this is what she <br />wanted, however, in some states she cannot get this <br />13 <br />
