MINUTES <br />CITY COUNCIL <br />NOVEMBER 13~ 1996 <br />RESOLUTION NO. 96-11-277 - RESCINDING RESOLUTION N0. <br />96-10-260 <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (4) LaValle, Fahey, Pedersen, Morelan. <br />Nays (O). Resolution declared adopted. <br />Fahey noted that the public hearing on this application <br />was closed at the October 23rd meeting. Fahey asked if <br />there was anyone present this evening from the general <br />public wishing to comment on this issue. There was <br />not. <br />Morelan asked for an outline of Council Member Scalze's <br />concerns. Morelan stated that the request to locate a <br />business consisting of indoor batting cages and <br />basketball courts fit the spirit of the existing <br />ordinance. The text amendment before the Council <br />clarifies the use and is actually more limiting than <br />the existing ordinance. <br />Fahey pointed out that the City Attorney felt the <br />existing ordinance was not clear on the issue, <br />therefore, had recommended the text amendment. Fahey <br />noted that the Planning Commission has discussed the <br />proposed text amendment and felt making this <br />recreational use a Conditional Use would not be <br />burdensome to the applicant and would give the Council <br />additional control over such issues as hours of <br />operation, etc. Fahey noted that the City has received <br />letters of concern from two businesses in the area. <br />The CUP process will allow the City to place controls <br />on the business which will address these concerns. <br />The Administrative Assistant quoted the concerns raised <br />by Council Member Scalze at the August 28th Council <br />meeting when the concept of this proposal was first <br />discussed. <br />Morelan stated that in principle, he would agreed with <br />Scalze's concerns. However, in realty, the indoor <br />batting cages and basketball courts proposed by Grand <br />Slam would require a building with higher ceilings. It <br />would be difficult to find this type of building in a <br />commercial area. <br />Morelan felt that Grand Slam would be a good business <br />to have in the City, pointing out that the only <br />similar-type business is Bwana Archery on Country <br />Drive. The question is, where is this type of business <br />best located. Morelan felt that, in principle, it was <br />2 <br />
