MINUTES <br />CITY COUNCIL <br />DECEMBER 18~ 1996 <br />THE LICENSE PERIOD JANUARY 1, 1997 THROUGH DECEMBER 31, <br />1997 SUBJECT TO PAYMENT OF THE APPROPRIATE LICENSE FEES <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Scalze, Morelan, Pedersen, Fahey, LaValle. <br />Nays (0). Resolution declared adopted. <br />PUBLIC Fahey opened the continuation of public hearing to <br />HEARING - consider a Variance for rear yard setback as requested <br />VARIANCE by Belland's Auto Repair. There was no one from the <br />FOR REAR general public present wishing to comment on this <br />YARD matter. <br />SETBACR - <br />BELLAND Upon motion by Morelan, seconded by Scalze, the public <br />hearing was closed. <br />The City Administrator reported that Belland's has <br />indicated they would send a letter withdrawing their <br />variance application. The reason for the withdrawal is <br />that Belland's is currently negotiating with NSP for <br />the acquisition of a strip of property which would <br />eliminate the need for a variance. Aowever, that <br />letter was not received today. <br />The Administrative Assistant reported that the City's <br />6o-day period for acting on the variance application <br />expires today. The Administrative Assistant pointed <br />out that the application submittals are incomplete in <br />that Belland's were asked to submit a copy of their <br />easement agreement with NSP, and this agreement was not <br />received. Therefore, the variance application can be <br />denied based on an incomplete application. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-12-304 - DENYING THE BELLAND AUTO <br />REQUEST FOR REAR YARD SETBACK VARIANCE BASED ON THE <br />FACT THAT THE APPLICATION MATERIALS ARE INCOMPLETE <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Pedersen, LaValle, Fahey. <br />Nays (0). Resolution declared adopted. <br />PUBLIC Fahey opened the public hearing to consider an <br />HEARING - amendment to the Zoning Code to allow for the <br />AMEND regulation of mobile home parks as non-conforming uses. <br />ZONING CODE Fahey noted that the amendment would be an adoption of <br />RELATIVE State Statutes which already exist to regulate mobile <br />
