MINUTES <br />CITY COUNCIL <br />APRIL 23, 1997 <br />to see some reasonable progress with that issue, and Donovan needs to <br />make a decision as to whether or not they can stay at the site long-term. <br />Fahey pointed out that these concerns were all discussed in 1987. It is ten <br />years later and Donovan is still using a trailer for temporary office space. <br />Scalze pointed out that the trailer has not been used continuously over the <br />past ten years. <br />Shamp reported that it is Donovan's intention to discontinue use of the <br />trailer. They will be leasin~ office space at Rice Street and County Road <br />C, and will remove the trailer from the property. Shamp indicated that he <br />needs an answer on what would be a viable street improvement on the <br />west side of their property. <br />Fahey pointed out that the Council deUated the iroad issue with Roseville <br />Plumbing and Donovan Constiuction in 1987 and decided at that time that <br />there would be no building pennits issued wrtil the road improvement is <br />made and title problems on the Donovan property are cleared up. Fahey <br />indicated that he was troubled by the Planner's recommendation that <br />Donovan should be allowed to expand without the road improvement. <br />Shamp explained that Donovan Construction was purchased by a new <br />owner in 1995. Shamp was not sure that all the history of the property had <br />been communicaYed to the new owner. Shamp also pointed out that <br />Donovan has been trying to clear up the boundary issues in order to get a <br />Torrens title for the property. Shamp reported that Donovan does not <br />want to build on the property until these title problems are cleared up. <br />Shamp asked if the City would be rec~uiring a 9-ton road to access the site <br />and pointed out that there is only a 33-foot easement existing. Shamp <br />pointed out that if a road is improved along the west edge of the property, <br />this will eliminate the parking area for the property immediately south and <br />make that property useless. Shamp felt that a 9-ton road was not needed. <br />Sl~amp felt the Plauner's recommendation made the most sense. <br />Fahey indicated that he was O.I<. with the couYinuation of tlie CUP. <br />Shamp replied that the CLTP is no longer an issue since they will be leasing <br />office space and removing the trailer. <br />Faltey iudicated that Donovan needed to meet City standards just like <br />everyone else. The existing situation is grandfathered in. However, the <br />building cannot be expa~~ded until there is road access. To do otherwise <br />would give Donovan favorable treatment that is not afforded to anyone <br />else.
