SECTION 5. Chapter 915, Section 915.130, of the Little Canada Zoning Ordinance is amended to <br />read as follows: <br /> <br />915.130 Fences <br /> <br />A. Permit Required <br /> <br />1. No persons, firm, or corporation shall construct or erect any fence without first <br />securing a permit. <br />2. Permit Requirements: <br />a. Application signed by property owner. <br />b. Permit Fee. <br />c. Depiction of fence and description of fencing materials. <br />d. Proof of compliance with 915.130B(3) if applicable. <br />e. Survey conducted by Registered land Surveyor, if requested by Zoning Official <br />or designee. <br />3. Fence Permit shall be issued administratively by Zoning Official or designee. <br /> <br />B. General Standards <br /> <br />1. Location and Property Line Verification. <br />a. All fences must be located entirely within the lot lines of the subject site unless the <br />owner of the adjoining property agrees, in writing, that such fence may be erected <br />on the division line of the respective properties <br />b. The property owner is solely responsible for ensuring that all fences and walls are <br />placed within the lot lines of the subject property <br />c. The City may require the property owner to locate and visibly mark property <br />corners, such as survey irons or stakes. <br /> <br />2. Construction and Materials <br />a. Every fence shall be constructed in a substantial, workmanlike manner and of <br />material reasonably suited for the purpose for which the fence is proposed to be <br />used. <br />b. All fences shall be so constructed that the finished side faces away from the fence <br />owner's lot. <br />c. Any fence that fully encloses a portion of a property shall include at least one gate <br />to allow for emergency access and access to any public or private easements. <br /> <br />3. Stormwater Obstruction <br />All fences within five (5) feet of property lines shall be constructed in such a manner <br />not to obstruct or divert natural stormwater drainage flow unless it has been reviewed <br />and approved as part of a site plan review. <br /> <br />4. Maintenance <br />a. Every fence shall be maintained in such condition as to not become a hazard, <br />eyesore or public nuisance.
