material, leans more than ten (10) percent out of vertical, or other conditions as <br />deemed by the Building or Zoning Official. <br />b. Any fence which endangers the public safety, health or welfare shall be considered <br />a public nuisance and abatement proceedings may be instituted by the proper City <br />Official if within fifteen (15) days after notification the owner of such fence has <br />not undertaken the necessary repairs to himself abate the nuisance. Link fences, <br />where permitted, shall be constructed in such a manner that no barbed ends shall be <br />at the top. <br />c. The required maintenance of chain link fences with slats (where permitted) shall <br />include the replacement of broken slats, damaged posts, and bent or broken rails. <br />d. Required maintenance of wooden fences shall include the replacement of broken or <br />rotten boards. <br /> <br />5. Berms <br />If a fence is placed on a berm, the combined height of the berm and the fence shall not <br />exceed the permitted maximum fence height plus one (1) foot, measured from the <br />ground level at the base of the berm on the side of the fence with the lowest existing <br />grade. Industrial properties may be granted additional height if approved as part of a Site <br />Plan Review. <br /> <br />6. Visibility Triangle <br />On all corner lots, fences located within 30 feet of the intersecting property line shall <br />be subject to the visibility triangle setback of 30 feet found in Section 915.030. <br /> <br />7. Walls <br />Masonry walls and other types of privacy walls are considered a type of fence and are <br />subject to all requirements of this section unless otherwise specified. <br /> <br />C. Height Regulations <br /> <br />1. Residential Districts <br />a. Front Yard. No fence located between the front property line and the front facade of <br />the principal structure shall exceed four (4) feet in height. <br />b. Side and Rear Yards. Fences in non-corner side and rear yards shall not exceed six <br />and one-half (6.5) feet in height. <br />c. Corner Lots <br />i. Fences in corner side yards shall not exceed four (4) feet in height, except <br />when adjacent to arterial roadways. <br />ii. On corner lots whose corner side yard abuts an arterial roadway, fences in <br />that side yard may be up to six feet in height, provided that the fence is <br />setback at least ten feet from the property line abutting the right-of-way or <br />any pedestrian or road easement and plantings (shrubs or trees) as approved <br />by the city are established and maintained between the fence and the right-of- <br />way or easement.
