MINUTES
CITY COUNCIL
JULY 23, 1997
Moser replied that both were issues. Moser pointed out that the building
will be within 125 feet of his pool. Moser indicated that he will have a
lar~e building to look at, and did not feel this was the type of building
which should be allowed in a residential neighborhood. Moser stated that
he could not understand why this size of a building was necessary to store
pool supplied and a lawn tractor. Moser felt there was no need for a
building of this size in a residential neighborhood. Moser indicated that
his lot is 275 feet deep, while Herkenhoff's was 400 feet deep.
Scalze pointed out that the property lines for the Herkenhoff and Moser
lots are offset. Therefore, the corner of the Herkenhoff lot abuts the
middle of the Moser lot. Scalze noted that according to Code, the City can
approve a Conditional Use Permit for up to 1,500 square feet of garage
space. However, a CUP allows the City to place conditions on the
approval. Scalze asked if the garage would be less objectionable to Moser
if it were closer to the Herkenhoff house.
Moser agreed that the CUP would be more acceptable if the garage were
moved toward the Herkenhoff house or toward the northwest side of the
lot.
LaValle pointed out that the City has ~ranted similar CUP's to other
property owners, and felt the Herkenhoff request was not out-of-line.
With regard to location, LaValle pointed out that the northwest corner of
the lot is low and would require fill. Therefore, the southwest corner was
the better option. LaValle felt it was not offensive for a property owner to
have to look at a~arage if the ~;ara~e is done right. LaValle stated that he
did not f'eel additional restrictions over and above what the City Planner
and Plannin~ Commission have recommended were necessary.
Morelan felt the size of the gara~e was on the large side, and asked
Herkenhoff what his plan was for using the garage.
Kathy Herkenhoff reported that the garage will not be used for any sort of
repair work, but rather for storage purposes. Herkenhoff listed the various
pool supplies, lawn furniture, mowing equipment, etc. which would be
stored in the garage. This second garage will free up space in the existing
garage so that vehicles can be parked in it.
Scalze asked why the ~ara~e was not located closer to the pool to make it
more convenient to access.
Kathy Herkenhoff explained the layout and use of their property, pointing
out that the southwest corner was the only logical location for the gara~e.
