FRANK <br />FRATTAI.ONE SDBJECT TO EVIDENCE OF EXECUTION OF THE <br />PURCHASE AGREEMENT MR. FRATTAI.ONE HAS ON THE <br />PROPERTY, .SU73JECT TO COMPI.IANCE WITH THE <br />RECOMMENDATIONS OF THE PU13I.IC WORKS DIRECTOR AND <br />THE CITY ENGINEER AND WITH THE INDICATION THAT <br />APPROVAI, OF THE GRADING PERMIT DOES NOT RESUI,T IN A <br />COMMITMENT 73Y THE CITY TFIAT THE CITY SUPPORTS <br />DEVEI OPMENT OF AN IND IISTRIAL I3 UII DING ON THIS SITE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Morelan, Fahey, Scalze. <br />Nays (0). Resolution declared adopted. <br />ASSE5SMENT The City Attorney reported that the court has upheld the City's <br />APPEALS assessment for the Lakeshore/Old County Road C/Jackson Street <br />improvement in the case of the Waite property. With re~ard to the <br />Marzitelli property, the court has remanded the matter to the trial court to <br />set a maximum assessment amount. <br />6 <br />
